| 无居民海岛，作为海洋资源的重要载体，承载着我国生态、经济、科研、海洋权益和国防安全的多重价值，对于无居民海岛的军民融合也一直是学界热议的焦点。2010年3月1日正式施行的《中华人民共和国海岛保护法》（下称《海岛保护法》）标志着无居民海岛可以得以合法开发利用。但是，作者通过对学界相关论文的浏览，发现《海岛保护法》及现有法律性文件存在着立法目的、立法原则、制度建设等方面的问题和缺陷，对无居民海岛的生态保护是无法做到全面保护的。然而，我们欣喜地看到，十八大以来，习近平总书记明确提出，要深入实施军民融合发展战略，并将其作为一项国家战略加以推进。在此背景下，作者认为，如果通过军民融合战略对无居民海岛进行环境与自然资源保护,可以对《海岛保护法》的缺陷进行弥补，在促进军民融合发展战略的落实的同时，兼顾环境保护效的质量和经济发展的效益，更好地维护国家主权和国家生态安全。 |

| Non-residential islands as an important carrier of marine resources, carrying the multiple values of China''s ecology, economy, scientific research, maritime rights, and national defense security, the integration of military and civilian for uninhabited islands has always been the focus of academic debate. The "Island Protection Law of the People''s Republic of China" (hereinafter referred to as the "Island Protection Law") formally implemented on March 1, 2010 indicates that the islands without residents can be legally exploited. However, the author found that the "Island Protection Law" and the existing legal documents have problems and defects in legislative objectives, legislative principles, and system construction through the review of relevant academic papers, and cannot completely realize the ecological protection of non-resident islands..However, we are pleased to see that since the 18th National Party Congress, General Secretary Xi Jinping has clearly stated that it is necessary to thoroughly implement the military-military integration development strategy and to promote it as a national strategy. In this context, the author believes that if the protection of the environment and natural resources of non-residential islands is carried out through the military-civilian integration strategy, the deficiency of the “Island Protection Law”can be remedied, and at the same time as promoting the implementation of the military-military integration development strategy, taking into account the environmental protection The quality of efficiency and the benefits of economic development will better safeguard national sovereignty and national ecological security. |
